      FEDERAL PRISONERS.

      A Batch Taken to Northern Prisons Last Night.
      United States Marshal R. M. Love left last night for Detroit, Mich., with the following prisoners for incarceration in the penitentiary at that place: John Anderson and ---- Poplin, pasing counterfeit money, two years each; Adam Lockhart, opening a letter not addressed to him and appropriating $10 contained therein, two years, and L. A. Donaldson, forging and using keys to the Waco postoffice, four years ago.

      Mr. Love was undecided as to the course to pursue in the case of L. A. Lincecum, city marshal of Midlothian [Ellis County], who was convicted a year ago of sending an obscene letter through the mail and sentenced to a year and a day in the Columbus, O., penitentiary. It seems that Lincecum appealed from this decision and the higher court affirmed it a few days ago and Marshal Love was instructed to take the prisoner to the penitentiary. Mr. Lincecum's attorney, however, raised the point that as the prisoner had been in jail all his time he had already more than served his sentence and to Columbus a writ of habeas corpus would be sworn out to demand Marshal Love's authority for his action. Judge Swayne of the circuit court held that he had nothing to do with the case, as the sentence had already been affirmed -- and ordered executed. After obtaining legal advice on the subject Mr. Love took Lincecum along with the balance of the prisoners when he left yesterday afternoon.

      It seems that in the federal courts it is the rule for the judge in passing sentence to say subject to appeal, which, it is claimed, Judge Rector, who tried the case, neglected to do in this instance.

      Golden Wedding Pair Celebrate
      Mr. and Mrs. Luke A. Lincecum of 1218 D Street today celebrated their golden wedding anniversary at a celebration in the home of their son, Captain of Detectives Mont W. Lincecum, 2322 Second Avenue.

      The couple were married in Texas in 1892 and have six children, ten grandchildren and one great grandchild. Lincecum is 83 and his wife is 66.

      The following sons and daughters attended the celebration: Officer Earl Lincecum, A. C. Lincecum of Sacramento; Mrs. T. P. Morrow of Jackson, Amador County; Mrs. Thomas Lafferty of Dunsmuir, Siskiyou County, and Scott Lincecum, an army sergeant stationed in San Bernardino.

      LINCECUM -- Entered into rest in this city, December 2, 1944. Luke Anderson Lincecum, husband of Ida A. Lincecum, father of Earl L., Mont W., Altus G. Lincecum and Scott F. Lincecum of the United States Air Force, South Pacific. Mrs. T. P. Morrow and Mrs. T. C. Lafferty of Dunsmuir, brother of Lon Lincecum of Texas, also leaves 13 grandchildren and two great grandchildren; a native of Texas, aged 85 years. Friends are invited to attend the funeral Tuesday at 2 P.M. from the Palm Chapel of James R. Garlick, corner of Twentieth and P Street. Interment Masonic Lawn.

      Lincecum died today in his home at 1218 D Street. He was a retired farmer and had resided in Sacramento since 1926. He was born in Washington, Tex.

      He is survived by his wife, Mrs. Ida A. Lincecum; his sons, Earl L. and M. W. Lincecum of Sacramento, Altus G. Lincecum of Redding, Shasta County, and Scott Lincecum with the air forces in the South Pacific; his daughters, Mrs. T. P. Morrow and Mrs. T. C. Lafferty of Dunsmuir, Siskiyou County; his brother, Lon Lincecum of Vernon, Tex., and 13 grandchildren and two great grandchildren.
